The manufacturer of Nexium has agreed to pay $65 million to settle lawsuits by people who claimed the drug had an "addictive, potentially fatal" side effect called "anaphylaxis."
Nexium, the brand name for the drug, is a prescription drug prescribed for adults with heartburn or acid reflux.
"We are a family-owned, independent company that's committed to providing affordable, low-cost medical care to millions of people across the country," said David Pappas, Nexium's president and chief executive officer. "We are committed to continuing to fight to save lives."
The case centers on Nexium's website and its maker, AstraZeneca. The suit, filed last week, claims the company knew of the dangerous side effect when patients took Nexium in the early 2000s and knew of the drug's fatal side effect at that time.
AstraZeneca argued the company knew of the drug's potential side effects and that, as a result, it was not adequately warned of them when patients took Nexium.
The plaintiffs, who sued AstraZeneca in September 2013, claimed the company knew the drug was dangerous and that consumers who took the drug were taking the "stupid, dangerous" side effects.
The plaintiffs said they believed the company acted responsibly and that the warnings were given based on clinical studies that have shown the drug may cause a severe, potentially fatal reaction.
"It was very misleading to the consumers," said Daniel Tumas, a spokesman for the plaintiffs' lawyers.
Nexium is a branded version of the drug Pfizer Inc. It was the first drug to be approved by the Food and Drug Administration for the treatment of acid reflux disease. It was also the first drug in the world to be approved by the FDA for the treatment of heartburn and acid reflux disease. The U. S. FDA approved the drug in 2003.
The plaintiffs claim the FDA had knowledge of the dangerous side effects before the FDA approved Nexium. They said the company knew of the risks before the drug was introduced and had warned patients about the warning at the time.
"We are aware of the serious side effects of this drug, including heartburn and acid reflux," said George A. Martin, an attorney for plaintiffs.
"Our company is not doing a good job of monitoring the safety of drugs that may cause dangerous side effects."
The plaintiffs also said AstraZeneca should have known of the warning earlier.
"We've been making progress in that regard, but we've been working with a different company and we believe that we will continue to do that, and we have a long-term plan," said Dr. William J. Morris, president of the New York-based group that has filed the case.
"But we have been working very hard to protect consumers and patients and we're committed to fighting aggressively against that, but we don't have a plan for that."
AstraZeneca is a small, independent global health company based in Israel. It was founded in 1993 as a pharmaceutical company and was later incorporated. AstraZeneca is the largest generic-drug maker in the world.
AstraZeneca has more than 5 million employees globally, more than double the company's workforce of 3.1 million.

"We're going to have to go back and work with a different company, but I think we have a long-term plan for this, and we have a long-term plan," said George Martin, president of the New York-based group that has filed the case.
In a statement released Thursday, the company said it would pay $65 million to settle the plaintiffs' claims.
In the first quarter of next year, AstraZeneca will pay $37 million to resolve a class action brought against several drug companies and their employees who claim the company knew about the side effects.
